In accordance with Article 4, the Haupttreuhandstelle Ost is entitled to
transfer its rights to local Treuhandstelle and other authorities. A large number of
legal provisions regarding all problems connected with the Treuhandstelle stem
from Article 5, which authorises the Haupttreuhandstelle Ost to issue ordinances
and executive regulations necessary to perform its tasks. Such regulations are
to be published in: Deutsche Reichsanzeiger and Preußische Staatsanzeiger,
Verordnungsblätter der Reichsstatthalter, or Amtsblätter der Regierungs-bezirke.¹⁹³⁹
[4] Article 6 specifies the geographic scope of the Haupttreuhandstelle
Ost’s jurisdiction. Its jurisdiction extends to the eastern territories incorporated
into the Reich. The next provisions of Articles 6, 7 and 8 are of no practical
importance for the matters in question.
II. LIABILITIES OF ENTERPRISES
The issue of debt settlement by Treuhänder comes to the fore of issues related
to Jewish assets and enterprises. Pursuant to § 5 of the Ordinance of 12 June
1940 (Reichsanzeiger, 139/40), the Haupttreuhandstelle Ost repealed an ordinance of 3 April 1940 and replaced it with the currently applicable SECOND
ORDINANCE of the Haupttreuhandstelle Ost on the settlement of claims
against enterprises managed by appointed administrators in the annexed
eastern territories (AO, 5) of 19 June 1940, Ranz.¹⁹⁴⁰ 141 of 19 June 1940.
This ordinance contains the following instructions:
I. Restrictions of payment:
Article 1
Appointed administrators may cover any liabilities resulting from personal
and property-related legal relationships only to the extent permitted by
the following provisions.
